Ms Gale, After getting feedback from the community, I am aware of the one complaint against Terry Villa that was forwarded to you. At this point, the community does not wish to pursue recognizing Terry Villa as a nuisance bar. I am encouraging the community to report all illegal activities, whether they are related to a business, residence or individual. I thank you for the opportunity to give input on the LCB license renewals. We appreciate knowing that if we have an issue with a local establishment, the community can count on support and assistance from Representative Preston and his staff in resolving the issue. [Highland Park] LCB License Renewals--Final Email

That was quite a lively discussion we had. As you know, with the LCB licenses up for renewal, the community has the opportunity to provide input on the review of the licenses. After all of this discussion, there has been one instance of someone reporting a violation of the license at Terry Villa. This has been passed on to Rep Joe Preston's office, and they are asking for same additional input. As far as I understand, the LCB and other authorities will not consider taking action against a "nuisance" establishment (and they have a definition of this, it is not subjective) without community support. I have been asked, as the President of the Highland park Community Club, if the Highland Park community is behind the "review of the license at a hearing prior to official action of the Board". I feel that I can not speak for the community until I get feedback. So I am asking for feedback as to whether the community feels that a further review of the license is needed. I hear a lot about how "bad" several establishments are in the neighborhood, and am not looking to pick on one of them. The LCB has guidelines for the establishments that are licensed to serve or sell alcohol. If these guidelines are broken, then the LCB can take action. But they need documentation of the abuses. This could be reports to the LCB or police. The LCB needs some information to go on. Now they will have one report against one establishment in the neighborhood. I am not trying to minimize the importance of that one report. If community members knows that ANY establishment is breaking the law, they need to report and document this. So I am asking for feedback that I can pass on to Rep Preston, who will then pass it on to the LCB. Do you feel that the LCB should act on the information about Terry Villa, and identify this establishment as a nuisance? I would like you to respond directly to me at bob.63(a)netzero.net. No responses will be published to the email list, although I appreciate all of the discussion that has been going on the past few days. Also, if you feel that a business in the neighborhood is a "nuisance", then please document and report any illegal activities. I have read all you emails regarding this establishment and I should let you know that it is entirely to late to build a case against Terry Villa for this objection year (2005), but we can start to compile reports, citizen complaints, etc. for the next objection. I can also come to a community meeting and advise you of the steps needed to be taken. First of all, you must decide if this place is a Nuisance to your community. C'mon folks we are treading in shallow water. First of all, since we are all judgmental, the word "nuisance" needs to have a criteria attached with it -- otherwise it is a recipe for profiling -- racial or otherwise. For example, I could call Tazzo D'oro "the coffee bar" a nuisance -- due to the sidewalk being blocked when I choose to jog my route. But I won't because I love having the option of stopping in and having a bold one. I don't go into any of the bars around here -- or anywhere. I just don't want to see anyone's enterprise threatened because we have become a little full of ourselves. [Highland Park] Highland Park CDC Bryant Street Activities

Dear Neighbors, As head of the Project Committee of the Highland Park CDC (HPCDC), and in light of the recent e-mail string, I would like to take this opportunity to update you on what we have been doing to improve Bryant Street generally and the possible future of Terry's Villa. In a nutshell, we have been working with a private developer to construct a series of multi-use buildings spanning from D&L Cleaners up to, and possibly including, Terry's Villa. The first floors would be reserved for neighborhood serving retail and services, and the upper floors would consist of professional offices and residential apartments. That's the short version ... as for the long version .... A few years ago, after a competitive RFP process, the HPCDC entered into a development relationship with Don Carlson, a developer with experience in Highland Park (you can see his work at the formerly vacant and fired out Callowhill Apartments on Callowhill Street). Since that time the CDC has been been working with Don on a site plan to develop all of the property from the corner of N. St. Clair and Bryant (including the former D&L Cleaners) up to and including Terry's Villa, cognizant of the many concerns that Highland Parkers have expressed over the years regarding the sale of alcohol to minors at the establishment. Though we at the CDC were not at liberty to share this news with the community until such time as those properties were under site control either by the CDC or Mr. Carlson, I am pleased to announce that we now have those properties either in our portfolio or under agreement. What does that mean for the future of Bryant Street and Terry's Villa? Our current plans call for the construction of a 2-3 story building (which will actually look more like a series of buildings) with first floor "neighborhood friendly" retail (family restaurant, dry cleaners- businesses that Highland Parkers have been clamoring for) and second and, possibly, third floor professional office space and residential. This development will likely span from D&L Cleaners up to, and including, Terry's Villa. This development will change the face of Bryant Street, provide us as Highland Parkers with businesses we have been seeking, and spur further positive activity on Bryant Street. While exciting, this project will take time, though we hope to break ground in 2005. In the interim, and perhaps beyond, Don Carlson and his associates have been working to acquire Terry's Villa. Under their current scenario, if all goes well, Mr. Carlson will reopen Terry's Villa, which will be operated on a daily basis by the son of the current owners of Terry's Villa. They will eliminate much of their alcoholic beverage sale business and will create a new menu, hopefully including a diner-style breakfast. This arrangement, therefore, will not only provide our neighborhood with more, and better, services and eradicate alcohol sales to minors, but also provide our community with a voice as to the operation of Terry's Villa due to the CDC's relationship with Carlson. In the next few months you will hear much more about these plans, and have the opportunity to provide guidance through a public input process at Highland Park Community Club meetings. So, with the HPCDC's residential development plans on Mellon and Negley coming to fruition this year AND the exciting happenings on Bryant Street, great things are happening in Highland Park! There is a very bright and clear line and criteria about what constitutes a "nuisance" and selling alcohol to minors is against the law. Let the law determine the appropriate action for whether the business should retain its liquor license. All the other issues are superfluous, speculative and specious. I think it reckless to start fanning the flames to label any business a nuisance if we can't agree on clearly defined criteria. Is a place a nuisance after one underage sale? Or is it two?
