That was before my time on the list so I am glad you sent it. It's a shame the person that originally sent the email did not include relevant links as it sounds dubious to me that I can be fined for hiring someone to do some work. Also the use of the term ""scab-non-certified"" leaves me without words. There are various links available to us that talk about EPA lead certification in more detail. Nowhere have I read that the person doing the hiring is liable for fines. The moral of the story would be to educate yourself. I may be getting to this story late as I'm sure there were replies to the thread when the original email was posted about the FUD (fear, uncertainty, doubt) being spread in that email. >From http://www.leadcertificationpa.com/faq/ you can read things like this: "As of April 22, 2010, anyone who conducts renovations, repairs, or painting in pre-1978 or child-occupied facilities must get certified. " "Is painting considered renovation if no surface preparation activity occurs? No. If the surface to be painted is not disturbed by sanding, scraping, or other activities that may cause dust, the work is not considered renovation and EPA's lead program requirements do not apply. However, painting projects that involve surface preparation that disturbs paint, such as sanding and scraping, would be covered." At http://www.epa.gov/lead/pubs/sellsheet.pdf you can read this sort of thing: Any contractor, including renovators, electricians, HVAC specialists, plumbers, painters and maintenance staff, who disrupts more than six square feet of lead paint in pre-1978 homes, schools, day care centers and other places where children spend time.

Hi everyone, You may recall that last summer we had our oak floors refinished by The Sandman (Jim Williamson). In the process of moving furniture the workmen put all kinds of articles on our newly refinished mahogany diningroom table. That resulted in a 6 inch gouge on top of the table. Although Mr. Willimason stated he would submit to his insurance, he never did. Instead we received a letter from a lawyer saying he would give us a minimal amount of money that in no way covered the cost of refinishing the table. We had two people look at it and both said they would need to take the finish down all the way as the gouge was so deep. We ended up hiring this person as he does work for the museum. He did a fabulous job. We had to take Mr. Williamson to a magistrate. He showed up with a lawyer. We won the case at that level and Mr. W. appealed that. Yesterday we went before an aribitration panel and learned today we won again, the full amount we paid to have table refinished. Once again Mr. W. had his attorney present who gives new definition to the term obnoxious. Mr. W. has 30 days to decide if he wants to appeal the arbitration hearing in which case it will go to a judge. I think it is beyond reason at this point at the total amount was $800 which he could have submitted to insurance. In this whole process we were told that a contractor who does more than $5,000 a year in business has to provide a written contract. Mr. W. did not. I am writing this in the event people are thinking of resanding their floors. Marsha Aarons

I have received several responses from people thanking me for posting the details of our experience. I have also received several emails from people who used the same floor refinisher and had bad experiences with him. I would encourage all of you who have had bad experiences to email the list and that it be saved with the list. If that had occurred we never would have used the person we did. Just as I like passing on names of workmen who do excellent jobs, I feel each of us in the community needs to share their experiences with the list.......both the good, bad and ugly. I think it will help in choosing a workman for those of us who are not members of Angie's list. Marsha

FYI: If you hire a "contractor" or a "handyman" they have to be EPA Certified and you MUST have a copy or the actual certification on site. If the "person/contractor/handyman" is NOT certified You AND THE "person/contractor/handyman" will be fined so that money you so wanted to save could cost you a years wages! Any "person/contractor/handyman" that is not certified will be turned in and checked on as soon as complaint is received. These un-certified "people" that give you that "cheap" price are putting you and your family at risk by spreading Lead & Asbestos dust/particles etc for you and your family to take in and are "killing" the industry and you for the companies that are COMPLETELY Certified that can't give the "scab-non-certified" prices. The trainings, the standards, the materials that ensure that you will be safe cost money which are not cheap. I hope this will enlighten those of you to what the standards are out there and being enforced. So, when you are looking for a $100.00 paint job it might cost you $1000's in the end and possibly your health.
